Introduction

Welcome to Clickyourguide (www.clickyourguide.com). These Terms of Service (“Terms”) govern the use of
our website and booking services.
By making a reservation through our platform, you agree to be bound by these Terms.

1. Role of GOLDEN COAST TRAVEL LTD

GOLDEN COAST TRAVEL LTD acts solely as a booking intermediary through its platform Clickyourguide
(www.clickyourguide.com). We do not own, operate, or manage any of the vessels or tours listed on our
platform.
All services are provided by independent third-party Providers, who are fully responsible for the execution of the tour.

2. Reservation Service Fee (Deposit)

Any amount paid to Clickyourguide (GOLDEN COAST TRAVEL LTD) at the time of booking constitutes a
reservation service fee (commission) only.
This fee covers the costs of online booking, customer support, and intermediary services provided by Clickyourguide.

  • The reservation service fee is non-refundable.
  • The execution of the tour, including safety, insurance, and compliance, is not related to this fee and remains the sole responsibility of the Provider.
  • The remaining balance of the tour price is payable directly to the Provider on the day of the tour, unless otherwise stated.

3. Provider Responsibility

Providers listed on Clickyourguide are responsible for:

  • Obtaining and maintaining valid licenses, permits, and insurance required by law.
  • Ensuring the safety and seaworthiness of the vessel.
  • Employing qualified captains and crew members.
  • Complying with all applicable maritime, tourism, and safety regulations.

GOLDEN COAST TRAVEL LTD (Clickyourguide) does not supervise or control Providers during the
performance of their services.

4. Customer Responsibility

Customers are advised to:

  • Request up-to-date insurance and license documents directly from the Provider prior to the commencement of
    the tour.
  • Verify that the vessel provided matches the booking confirmation (name, registration number).
  • Sign a simple written agreement with the Provider, where possible, for added security.

Failure to follow these recommendations may limit the Customer’s rights to claim compensation from
Clickyourguide (GOLDEN COAST TRAVEL LTD).

5. Disclaimer of Liability

  1. Clickyourguide (GOLDEN COAST TRAVEL LTD) carefully selects Providers and relies on their past service
    record. However, Clickyourguide may not always be physically present to verify documents (such as insurance,
    licenses, and permits) before each tour.
  2. All accidents, injuries, deaths, loss of property, or damages occurring during the execution of the service are the
    sole responsibility of the Provider.
  3. Clickyourguide (GOLDEN COAST TRAVEL LTD) shall not be held liable for any such events.
  4. The liability of Clickyourguide towards the Customer is strictly limited to direct damages arising solely from its
    booking services, and shall in no event exceed the total amount paid as a reservation service fee.

6. Unauthorized Vessel Substitution

  • Providers may not substitute a vessel without the prior written consent of Clickyourguide (GOLDEN COAST TRAVEL LTD). If a Provider operates the service with an unregistered or uninsured vessel, the Provider shall be solely liable for all damages.
  • The Provider agrees to indemnify and hold harmless Clickyourguide (GOLDEN COAST TRAVEL LTD) against any claims raised by Customers or third parties

7. Cancellations and Refunds

  • If a Provider cancels the tour, Customers may be entitled to a refund of the reservation service fee at the sole
    discretion of Clickyourguide (GOLDEN COAST TRAVEL LTD).
  • If a Customer cancels the booking, the reservation service fee remains non-refundable.
  • Refund policies for the balance payment (paid directly to the Provider) are subject to the Provider’s own terms

8. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved exclusively in the courts of England and Wales

9. Final Provisions

  • By booking through Clickyourguide (www.clickyourguide.com), the Customer acknowledges and accepts that GOLDEN COAST TRAVEL LTD is not the operator of the service, but an intermediary.
  • Providers are independent contractors and not employees or agents of GOLDEN COAST TRAVEL LTD.
  • Clickyourguide (GOLDEN COAST TRAVEL LTD) reserves the right to amend these Terms at any time.

10. Intermediary Role (Reinforced)

Clickyourguide (GOLDEN COAST TRAVEL LTD) acts solely as an intermediary platform for booking services.We do not own, operate, or control any of the vessels, tours, or activities listed on our platform. All responsibility for the execution of services, including safety, insurance, and compliance with applicable laws, rests exclusively with the Provider.

11. Provider Responsibility (Reinforced)

The Provider is solely responsible for ensuring that all legal, regulatory, insurance, and safety obligations are met. This includes, but is not limited to, maintaining valid licenses, permits, and insurance policies, as well as providing qualified crew and a seaworthy vessel.

12. Limitation of Liability (Reinforced)

Clickyourguide (GOLDEN COAST TRAVEL LTD) shall only be liable for damages arising from intentional misconduct or gross negligence directly attributable to its booking services. In no event shall Clickyourguide’s liability exceed the total amount paid by the Customer as a reservation service fee.

13. Force Majeure

Clickyourguide (GOLDEN COAST TRAVEL LTD) shall not be held liable for delays, changes, or cancellations caused by events beyond its reasonable control, including but not limited to weather conditions, government restrictions, strikes, natural disasters, or other force majeure events.

14. Provider Indemnification

The Provider agrees to indemnify, defend, and hold harmless Clickyourguide (GOLDEN COAST TRAVEL LTD) from and against any and all claims, damages, liabilities, losses, or expenses (including legal fees) arising from the Provider’s performance or non-performance of the services, including accidents, injuries, deaths, property losses, or third-party claims.

15. Governing Law and Jurisdiction (Reinforced)

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any
disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of London, England.
